Adair suggests that the test of an effective team is: â€Å"whether its members can work as a team while they are apart, contributing to a sequence of activities rather than to a common task, which requires their presence in one place and at one time. † Below is a discussion of some of the major factors that create a difference between winning and losing management teams . 1. Supportive Sponsor Management teams are usually formed by a sponsor who recognizes that reaching an organizational goal will require a group of individuals working together to provide the leadership necessary to move a company, division or unit towards the organizations goals. It is the sponsor’s responsibility to create a ‘charter’ that establishes the management team and its primary focus. In addition, the sponsor establishes specific goals the team is to accomplish. The sponsor will also select the team leader and gain his or her commitment to lead the leadership team in defining and carrying out the needed actions. Lack of will or proper direction by the sponsor ( e. g board of directors in a company) can lead to team failure. 2. Smart Goals Specific, measurable, achievable, realistic and time-bound goals should be established by the team’s sponsor and then broken into sub-goals by the management team. Without SMART goals, the team will lack the milestones necessary to drive action. 6. Team Leadership Team leadership is the most critical success factor for the performance management team. A leader with strong performance management skills and the ability to develop others virtually guarantees a successful performance initiative. Every management team needs a leader who focuses the members of the team on the mission, purpose, and goals of the team. This individual must be committed to the team’s results and must be willing to be held accountable by the team’s sponsor and other stakeholders, for leading the team through processes that insure the team’s goals are reached. The team leader must engage each team member in the processes of the team and build a platform of mutual trust that leads to open debate, collaboration, individual commitment, and personal accountability. 7. Mutual Trust The most important element of successful team work is the establishment of a platform of mutual trust that enables the management team to engage in open debate and decision making that leads to commitments to action by individual members of the team. Building this trust requires an openness that allows team members to know and understand the beliefs and behaviors of all members of the team so that team actions can be structured to take advantage of each members uniqueness and talents. Behavioral and values assessments are powerful tools in developing an understanding how each member of the management team views themselves and responds to others in the team. 8. Engaged Management Team Members An effective management team will have team members who are actively engaged in the work and focus of the team. This will require that each team member emotionally commits to actively and openly participate in the team’s processes in the pursuit of the team’s goals. The team member must willingly commit to carry out action plans to complete individual actions necessary for the team to reach their team goals. The team member must be dependable and carry the full weight of personal responsibility to complete their individual commitments by the date committed to. Engaged team members enthusiastically support each other and add value to other team members. They prepare for team processes and choose to engage others in a positive manner to find solutions to issues and challenges they individually or as a team face. They constantly seek to improve themselves for the benefit of the team and never, never, never quit. 9. Composition of the Team The Apollo Syndrome is a phenomenon that having too many people with a high mental abilities grouped together to solve a problem is, in many instances, detrimental to the teamwork process. Team members spend much of their time trying to persuade the team to adopt their own views as well as figuring out ways to point out weaknesses in the rest of the team’s ideas. They have difficulty reaching consensus in decisions and are focused on their own work, paying little attention to what their fellow team members agree doing. Occasionally the team will pick up on the fact they are having problems, but will then overcompensate to avoid confrontation. This leads to even more problems in making sound decisions. A knowledgeable team, skilled at group working, and with a wider range of talents is much more likely to succeed than an inexperienced group with a narrow range of talents. 10. Individual Commitments The work of a management team is carried out by individual members of the team. When a team has developed a plan of actions that are necessary to achieve their goals or overcome barriers, individual members must commit to carrying out specific actions which in many cases will include actions by the individual teams they in turn lead. The management teams collaborative processes must include steps to: * Define individual actions, * Gain the commitments by individual team members to complete the actions, * Document due dates, and * Establish status reporting processes. 11. Discipline and Accountability Team goals will usually not be realized until individual commitments are completed. Management team members must embrace a discipline to complete their commitments as scheduled. They must agree to hold each other personally accountable for completing, as scheduled, the commitments each person has made to the team. Each management team member must continuously report the status of their open commitments to the team so that barriers to completion can be identified early in order to permit the management team leader and other team members the opportunity to deal with the issues before overall deadlines are impacted. 12. Identification and Removal of Barriers Barriers to team and individual progress will occur in every management team effort and must be dealt with quickly to continue progress towards the teams goals. The team leader must continuously monitor the status of each individuals commitments and initiate barrier removal processes where appropriate. Team-based processes for developing action plans to overcome barriers impacting individual commitments should be instilled as a part of the teams culture. 13. Shared vision / approach. The ability for a management team to clearly state its goals and objectives and gain buy-in among the people they lead ( e. g. employees )along with a synergistic team that can carry out their responsibilities is vital to performance success. The vision and/or mission of the team must be accepted by all the team members and critical goals viewed as the collective responsibility of the team. If a return to profitability is a critical goal of an executive team, priorities and time commitments must be pulled from elsewhere. Focusing on results that in any way does not support the critical goal(s) of the team will lead to team failure. 14. Technology support While a skilled management team can improve performance with very little tools and only an effective approach, with proper technology to support the teams needs, and the proper data to drive decision making, there is almost no limit to the improvements an organization will yield. 15. Ability to Innovate Innovating is a key aspect of teamwork and involves challenging the way things are currently being done. Technology is changing so quickly that the way you are currently performing tasks may no longer be the best way. If you are not up-to-date in your practices, your cost structure may be too high or you may no longer be delivering competitive service. Innovating is essential for all work teams. There are always better ways of doing things if you only take time to discover them. 16. Promoting To obtain the resources people, money, and equipment to carry out your work, you have to sell what you are doing to other people. The Importance of Helping Friends in Leo Lionni's, Frederick and Swimmy In many of Leo Lionni's children's books, one of his characters is always helping a fellow friend out. For example, in Frederick and Swimmy, there are characters that help others to survive. These characters possess human attributes and carry across important messages to the reader. Frederick shows that just because he is not working with the other mice does not mean that he is not helping out. He is just doing it in another way. While the others are working to gather food for the winter, Frederick just sits there and takes in other things such as the "sunrays for the cold dark winter days", and "colors for the winter is gray", and finally words "for the winter days are long and many, and we'll run out of things to say"(3). The other mice may not believe what Frederick is saying, however in the end when they are cold and the sky is gray, and they are at a loss for words, they turn to Frederick who in turn shares with them everything that he had been saving up. By Leo Lionni writing this, he was able to show that people can help out others in many ways. Although Frederick was not doing the same things as the other mice, in the end he helped his friends to survive the long, cold, dark winter. What Frederick achieves by gathering his supplies, Swimmy achieves by being smart. In Leo Lionni's book, Swimmy, the odd fish is the one who in the end helps the other fish from being eaten by the big "tuna fish" who is "swift, fierce, and very hungry" (75). Swimmy does not want to have to constantly worry about being eaten by the big fish, so he comes up with an idea to help all of the other little fish survive the large fish. He has them all join together to become one big fish and he is the eye. By Swimmy coming up with this idea, he is able to protect all of his friends. Without his help who knows what would have come of all the other little fish. Although not all of Leo Lionni's books portray how friends can help other friends survive in different ways, Frederick and Swimmy are great examples of this.

On our assembly lines, we were trying to implement a new design that required radically new methods to assemble to the product. At the same time the operators were locked in negotiations with the management for a pay scale review. We had to come up with ways to get the operators to be motivated to start assembling the new designs. In a vehicle assembly line, feedback you get from the operator Is extremely Important when it comes to usability of a product assembly process.Manufacturing engineers design the processes In their head (especially for products that are not yet physically available for use) and hence need the operators to start using the prototype machines and facilities and start coming out with constructive feedback that lists the Improvements that workers feel will make their life easier and the production quality and volume targets can be met. But when the worker Is disengaged due to other considerations on his mind, coming up with constructive criticisms Is very difficu lt.Actually, criticisms were shared of the new facilities and processes but they are shared in a very destructive manner. Here we have a management that is demanding that the workers change their currently comfortable work environment (at least the one which they are now used to) and take up completely new processes which may or may not be beneficial to them while being engaged in a pay dispute. Based on the findings about what drives people, usually when the money is off the table autonomy, master and purpose are the key factors.The traditional carrot and stick approach may have worked before where the work involved was highly mechanical as there was no thinking necessary due to years of practicing one type of process. But here the workers had to get used to a completely new process and they had to suggest improvements. Management has a target to limit the pay increase while still maintaining morale and motivation for the worker. WLB from an employee perspective is the most important strategy of organisation. This article reports that the working hours have a significant relationship with the challenges faced by working couple. Data was collected from various countries like USA, India, Australia, and Canada. A total of 70-80 participants (working couples) indicated that long and odd working hours make their work-life imbalanced. Due to which they are unable to spend time with family and negatively effecting their organisation commitment. Also, these time constraints create more stressful conditions to work and giving unproductive results to organisations. We therefore, recommend all the organisations to implement work-life balance strategies which are family friendly policies and simultaneously, reaping benefits for the organisations too. For companies to remain competitive there is a need to attract and retain valued employees with regard to human resource policies and practices that address work-life balance. Therefore Work- life Balance is an important area of concern for Employers. Work life balance is about individual choices that enable employers and employees to manage the interaction between work and the demands of life that affect health, families and communities. Work/Life Balance: n. A state of equilibrium in which the demands of both a persons job and personal life are equal. According to Maryln Walton of Herman Millers Future Insight Group, The participants rated work-life balance as the most important of the propositions in the future. It also was rated lowest for the amount of attention being paid to it through the workplace. Therefore in todays organizational settings WLB strategies are being implemented like policies of flexible work and leave arrangements, child and dependant care, compressed work week, job sharing, etc. Review of Literature Working Hours and Dynamics Interplay between Work and Family Challenges A work/life balance survey conducted in 2002 by TrueCareers states that 70% of more than 1,500 respondents said they dont have a healthy balance between their personal and work lives. As organisations move towards more participative and flat structures where fewer employees are expected to manage increase workloads (Hall Ritcher, 1988), the demands of the environment increase, and maintaining the balance between the demands of a career and life responsibilities become more difficult. Hence an increasing level of stress can rapidly lead to low employee morale, poor productivity, and decreasing job satisfaction. Some of the specific problems that relate directly to productivity in the work environment are abuse of sick time, cheating, chronic absenteeism, distrust, embezzlement, organizational sabotage, tardiness, task avoidance, and violence in the workplace. Other serious repercussions are depression, alcohol and drug abuse, marital and financial problems, compulsive eating disorder s, and employee burnout. With ever increasing work overload there is always negative spillover of stress from office to home and from home to office. Working late hours, bringing work to home, less time for lunch at office hours are the common problems faced by working couple. Moreover, if the working environment is not supportive it may lead to more turnover as before. Employees tend to experience work-family conflict when demands from work and family are both high and difficult to satisfy. Work-family conflict is a form of interrole conflict in which incompatible demands emanating from work and family domains make it difficult or impossible to satisfy both sets. Employees from dual-earner families (the subjects of our study) are particularly likely to experience conflict between work and family. Whereas most research has focused on individuals and the work-family conflict they personally report, a growing number of studies suggest that work-life issues must be understood in the context of both spouses employment conditions. Employees tend to experience work-family conflict when demands from work and family are both high and difficult to satisfy. Work-family conflict is a form of interrole conflict in which incompatible demands arising from work and family domains make it difficult to satisfy both sets. Working couples are particularly likely to experience conflict between work and family. Whereas most research has focused on individuals and the work-family conflict they personally report, a growing number of studies suggest that work-life issues must be understood in the context of both spouses employment conditions. This study though examines the spousal support and his indulgence in work, being at priority. A 1991 study finds relationships among employees job security, income, and weekly work hours and their spouses job involvement and satisfaction. Longer working hours are considered as the biggest work-family conflict reason giving more challenges to be faced by working couple. Late working hours, night shifts, work at home, no flexible scheduling and rigid corporate timings all these are demanding flex time work strategies. In the last decade ( Health Canada 2001, National Work Life Conflict Study), declared that high job stress has doubled, high job satisfaction and employee loyalty has doubled, the percentage of Canadian working more than 50 hours a week has grown from 10% to 25% , most Canadian lives in dual-income families and have dependents, whether children, aging parents or both. Also Canadian employers has reported that work life conflict has resulted in increased absenteeism and employee turnover, reduced productivity increased disability costs and health cost, increased managerial stress, and impaired family/social relationships. Jacobs and Gerson (2001) proposed that total family work hours, or the combined work hours of both spouses, would be a stronger predictor of negative outcomes, especially among parents, than the work hours of the individual spouses. Total family work hours is a concept with considerable face validity; as Jacobs and Gerson (2001) note, married individuals have less time to spend at home, because they devote more joint time to work (p. 50). More recently, Voydanoff (2004b) argued that long work hours reduce the resources that couples have for managing home demands, with likely negative effects on marital quality that vary with gender. For example, long work hours have been associated with high work_family conflict (Grzywacz Marks, 2000) as well as with good physical health (Bird Fremont, 1991). In contrast, there was no significant relationship between long work hours and intention to turnover or life satisfaction (Barnett Gareis, 2000a,b). Therefore todays company need various work-life strategies to be implemented that are helpful for working couple. They will be able to maintain a balance between much needed personal and professional life. The workplace based strategy could be flexi-time and flexi hours, part time, job sharing, job redesign, compressed work schedule; and flexi-place strategy could be telecommuting. Leave arrangements could be compassionate care leave, extended leave, maternity leave, parental leave, personal leave, self-funded leave, sick leave. A review of more than 30 surveys regarding work/life balance published from 1997 to 2003 reveals that the number of employers who offer family-friendly benefits has dramatically increased. According to the SHRMÂ ® 2003 Benefits Survey by the Society for Human Resource Management (www.shrm.org /surveys-available late June 2003), the percentage of employers offering family-friendly benefits continues to increase.21 The survey documents that the top five family-friendly benefits offered are: Dependent care flexible spending accounts (71% of respondents). Flextime (55% of respondents). Family leave above required leave of the federal Family and Medical Leave Act (FMLA) (39% of respondents). Telecommuting on a part-time basis (34% of respondents). Compressed workweeks (31% of respondents). Research Methodology Data Collection A sample of 70-80 working couples was taken from various countries including USA, Canada, Australia and India to measure the effect of working hours on working couples and the challenges they face. Diverse type of corporate sector including service sector, medical sectors, NGOs, manufacturing sectors, educational sectors etc. were included A structured questionnaire was drafted containing various statement on Work-Life Balance and challenges. Giving a Chronback Aplha of .80 ( reliability and validity of questionnaire). Measurement Individual working hours effect was assessed on the lives of working couple. 12-items from the dual career couple challenge scale were used to assess the challenges experienced by them. Responses were gauged on a 5-point Likert-type scale ranging from 1 (never) to 5 (always). For example items including, Do you work late hours at office everyday?; Do you miss out on quality time with your family and friends because of work pressure? A higher response rate of 85% was recorded. Therefore, for measuring the effect of working hours on the challenges faced by dual career couple a simple regression analysis technique was applied with the help of SPSS 18 (PASW). Taking challenges as independent factors and working hours as dependent factors. Simple regression analysis was used to test the hypothetical relations between the challenges and working hours, in table 1. We can see the variables entered as independent. There is, therefore, a need for organisations to develop policies and practices that provide support for the demands of both work and family. In the work environment, dual-career employee status implies the need for greater employer sensitivity and awareness of the conflicting demands of simultaneous careers, so that employees may become more effective both at work and at home. What is needed is policies and programmes to help employees reduce the amount of conflict and the resulting stress they experience when they try to juggle the demands of work and home responsibilities (Thomas Ganster, 1995). Higgins, Duxbury and Irving (1992) for example, found that conflict between work and family roles reduce employees perceptions of quality of work life and the quality of family life which, in turn, can impact productivity, absenteeism and turnover. Suppo rtive work practices like flexible work options (e.g. flexitime, compressed work weeks, home telecommuting) as well as assistance with child and dependent care, employee support programme (e.g. counselling) and career path alternatives (Bardoel, Tharenou and Moss, 1998) are therefore vital to minimise stress, maximize employees sense of control over their lives, sustain manageable career progression, and at the same time balance career and family demands. Respondents situated out of India (home country) having problem while filling up the questionnaire were not able to discuss the doubts regarding the questionnaire because of distance and lack of time. Wrong information like telling wrong age or wrong spouse information cannot be avoided. An additional limitation based on the characteristics of the sample may be bias associated with nonresponse.

The Scopes Monkey Trial Research Paper

The Scopes Trial Today evolution is taught in public schools in America, but it has not always been that way. The legal battle that led to the teaching of evolution in public schools has been a very long one. Creationism was taught in public schools until the late 19th century. Following Darwin’s theories being introduced in 1859 many began to accept evolution during the 1860’s. This would continue in America until a flamboyant, Christian, lawyer named William Jennings Bryan campaigned against the teaching of evolution.Bryan found supporters very easily because of a grassroots movement in America following World War I; which was a vast change in society that led people towards a simpler and more religious lifestyle. This movement led several states to create laws banning the teaching of evolution in public schools. Bryan and his movement was of course opposed by many which led to the legal battles that have taken America from a non-evolution teaching society to the evol ution teaching society it is today. In this paper I will discuss the first major court case that brought significant national attention to these laws.The first major court case that brought significant attention to the laws banning the teaching of evolution in public schools is â€Å"The Scopes Trial† or â€Å"The Monkey Trial† in Dayton, TN in 1925. This trial was the State of Tennessee vs John Thomas Scopes, who was a high school football coach that was also a substitute. Although this case would turn out to be more about Scopes breaking a law than the teaching of evolution in public schools; it was significant in bringing national attention to the laws.After the state of Tennessee passed the Butler Act, which banned the teaching of anything that contradicted the idea of creationism from the Bible, there was a group of businessmen from Dayton, TN who felt they could bring business and attention to their small town thanks to the new law. They devised a plan to find a local teacher willing to oppose the law by teaching evolution in the classroom. They were able to find such a teacher in John Thomas Scopes; Scopes was the perfect candidate. He was young (25), new to teaching (first year), new to town, and was well liked by the towns people.It took little convincing to get Scopes to oppose the law and he did so while substituting a high school biology class. When knowledge of Scopes teaching evolution was made public he was arrested and taken to trial. The trial quickly grew in fame when two of America’s most prominent lawyers took the case. William Jennings Bryan volunteered to serve as the prosecutor for the State of Tennessee which led to Clarence Darrow becoming the Defending lawyer in the case. Darrow was a famous Agnostic, defense, lawyer who wanted to prove Bryan wrong more so than to prove Scope’s innocence.With the new â€Å"celebrity† lawyers on board for the trial; the case quickly gained fame. The business men of Da yton, Tennessee were quickly pleased to see their plan had worked. There were vendors, tourist, and media flocking to Dayton for the trial. The vendors were selling hot dogs, and water outside of the courthouse. The many curious people who came to Dayton to witness the trial caused the town to be flooded with people. All of the hotels were so full it led to many members of the media staying in a warehouse and sleeping on the floor.For the first time there was a national radio broadcast from the courtroom of the trial and the trial was recorded on film. There were so many people in the courtroom that the weight caused the support beams to buckle in the courthouse. The buckling of the beams lead to the trial being held outside one day; then returning inside with a limited amount of people able to attend. During the jury selection Darrow quickly realized he was at odds. It was hard to find an unbiased jury in Dayton Tennessee because the vast majority of residents were Christians and w as neducated on what evolution is. They saw evolution as a direct threat to their religion rather than a scientific theory. The jury ended up being made up of farmers who were mostly illiterate with the majority being church goers; six were Baptist, four Methodist, one Church of Christ, and one was a non-church goer. Since Darrow knew he could not prove that Scopes was innocent of breaking the law. He would rather try to prove that the law itself was unconstitutional; and decided to make his case based on science versus ignorance.He had planned on calling in several scientific scholars as witnesses to argue the topic of evolution over creationism but the judge deemed this unreasonable. The judge did not allow the witnesses and said that the case was about the law and not evolution. This was the case for Darrow but not for Bryan. Bryan argued that creationism was true and spent most of his time in court preaching from the Bible. Bryan even preached to the public on the courthouse ste ps and in the local Methodist church while he was in Dayton.This tactic won over the local people and even the defendant. Scopes was quoted saying â€Å" Bryan was a powerful speaker†. With Bryan’s tactics being allowed by the judge and going over well with the jury and local people Darrow saw only one way to â€Å"win†. Instead of trying to keep Scopes from being convicted he would make his case into a personal vendetta against Bryan’s beliefs. When Darrow presented his defense he called one witness; Bryan. This was a shock to everyone in the court as well as around the country.The judge allowed it as long as Bryan was okay with it. Bryan agreed so he took the stand to be questioned by Darrow. Darrow made the most of his opportunity and questioned the faith that Bryan held so dear. He began by asking him about stories from the Bible and how old the Earth was. He then delved deeper into the creation theory; asking if Bryan knew how long it took God to cre ate the Earth, if the days that were spoke of in Genesis were man’s days or God’s days, and if they differed. Of course; Bryan could not answer truthfully, only guess.This led to Bryan acknowledging that the periods of creation in Genesis could have possible been millions of years rather than days. This gave ground to the theory of evolution to be included in the creationist’s idea of the beginning. The day after Darrow questioned Bryan the judge ordered the testimony to be absolved from the case. He said that it had no bearings on the case. Scopes was found guilty and fined $100. Even though Darrow was unable to prove Scopes innocence he was able to show a chink in the armor of the creationist claims against evolution and make a bigger name for himself.Bryan died five days after the trial in Dayton Tennessee while taking a nap after lunch. Darrow appealed the case to the State Supreme Court in an attempt to get the law deemed unconstitutional. The Supreme Court found that Scopes should not have been fined but did not retry him. It was not until 1965 when the American Civil Liberties Union made a case against the state of Arkansas that the Supreme Court ruled that laws against the teaching of evolution were unconstitutional. CRJU 310 Judge Oberholzer April 12, 2009 Mapp v. Ohio * Mapp v. Ohio * 367 U. S. 643 * (1961) * Character of Action Mrs. Mapp was found guilty and sentenced to prison 1-7 years. Mrs. Mapp and her attorney took the case to the Supreme Court in Ohio. * Facts: Three police officers went to Dollree Mapp’s house asking permission to enter into her house, because they believed that she was hiding a fugitive in her home. When she did not allow the police officers into her home, the police officers left and came back three hours later with a search warrant. When Ms. Mapp asked the police officer if she could see the warrant, he held up a piece of paper that was believed to be a fake warrant. The police officer handcuffed Ms. Mapp for â€Å"resisting arrest†. As the police officers looked around her house, they did not find any fugitive but they did find pornographic material in a suitcase that was by Mrs. Mapp’s bed. Mrs. Mapp told the police officers that the pornographic material was not hers but that it belonged to another individual that she had loaned the suitcase too. Mrs. Mapp was arrested, found guilty and sentenced for having pornographic material. * Issues: A. Was the issuance of the warrant by the police officer invalid in violation of the Fourth and Fourteenth Amendments? YES. B. In the absence of a warrant, may a search and seizure take place in a person’s home without their consent? NO. C. Is evidence obtained, without a warrant, from voluntary submission of a third party inadmissible in a court of law in violation of the Fourth and Fourteenth Amendments? NO. * Decision: The Court held that the exclusionary rule, which prevents unconstitutionally btained evidence from being introduced at trial, applies to states as well as to the federal government. * Majority Opinion: (by Justice Clark) Issue (A) — Yes. Reasons: i. The Fourteenth Amendment requires that a â€Å"neutral and detached magistrate† must issue a warrant. ii. Justice Clark declared, â€Å"The exclusionary rule should also apply to states, saying that states are not permitted to use evidence gained by illegal means to convict a person. With a 6-3 vote of approval, Mapp's case was overturned and the law was forever changed†. Issue (B) — No. Reasons: i. Justice Clark declared, â€Å"We hold that all evidence obtained by searches and seizures in violation of the Constitution [is] inadmissible in a state court†¦ Were it otherwise†¦ the assurance against unreasonable†¦ searches and seizures would be [meaningless]†. Mrs. Mapp at the time of her arrest was not issue a warrant just a piece of paper. The police officers still searched her house without her consent. 09. Concerning Opinion: by (Justice Black) Justice Black shares the doubt that â€Å"The Fourth Amendment alone can be used to prevent illegally obtained evidence from being used in state courts because it is not explicitly stated. Justice Black also believes the command that no unreasonable searches or seizures be allowed is too little to infer such a large decision. With these differences aside Justice Black feels that along with previous court decisions that the â€Å"Fourth Amendment's ban against unreasonable searches and seizures is considered together with the Fifth Amendment's ban against compelled self-incrimination, a constitutional basis emerges which not only justifies, but actually requires the exclusionary rule. Concurring/Dissenting Opinion: (by Justice Clark, whom the Chief Justice joins) These two justices, Clark and Brennan came to an agreement with Mrs. Mapp that her rights as a citizen of the United States were violated. Both Justices used the Fourth Amendment and that is evidence obtained in violation of the Fourth Amendment, which protects against â€Å"unreasonable searches and seizures†, may not be used in criminal prosecutions in state courts, as well as federal courts. Concurri ng/Dissenting Opinion: (by Chief Black) Justice Black found that the case was a combination of the Fourth and Fifth Amendment and not with the Fourteenth Amendment. Justice Black turned out to be the swing vote. Even though, he joined the Court’s opinion he did it for his own reasons. For the reason, Justice Black wrote a separate opinion that was not joined by any other justice. Concurring/Dissenting Opinion: (by Justice Stewart) Justice Stewart wrote the majority opinion in Elkins. Yet, he refused to join the Court’s opinion. He did vote with the majority to reverse Mrs. Mapp’s conviction. 10. Comment: Mapp v. Ohio is an important case that made history. For the reason it has to do the Fourth and Fourteenth Amendment. All evidence obtained by searches and seizures in violation of the Federal Constitution is inadmissible in a criminal trial in a state court. Wolf v. Colorado, 338 U. S. 25, overruled insofar as it holds to the contrary. Pp. 367 U. S. 643-660. (A) A warrant must be issued by a â€Å"neutral and detached magistrate† who is not involved in either the investigation or prosecution of the suspect upon whom such a warrant is issued (Harvard Law Review, Vol. 5(3), 1971, pp. 239-250). (B) At the trial, no search warrant was produced by the prosecution, nor was the failure to produce one explained or accounted for. At best, â€Å"There is, in the record, considerable doubt as to whether there ever was any warrant for the search of defendant's home. † 170 Ohio St. at 430, 166 N. E. 2d at 389. The Ohio Supreme Court believed a â€Å"reasonable argument† coul d be made that the conviction should be reversed â€Å"because the methods' employed to obtain the [evidence] . . . here such as to `offend â€Å"a sense of justice,†Ã¢â‚¬ËœÃ¢â‚¬  but the court found determinative the fact that the evidence had not been taken â€Å"from defendant's person by the use of brutal or offensive physical force against defendant. † 170 Ohio St. at 431, 166 N. E. 2d at 389-390. Mrs. Mapp took a stand against the police officers because she felt she was doing nothing wrong. The police officers assumed that Mrs. Mapp was involved in hiding a fugitive as well as in hiding some illegal betting equipment. When the police officers got to Mrs. Mapp’s house they asked to go in she said â€Å"no†. Three hours later the police officers came back with a piece of paper (not a search warrant) when Mrs. Mapp asked to see the warrant she had to struggle to get it. The judges overturned the conviction because the police officers had violated the fourth Amendment. 11. Principle of the Case: A warrant issued by any public official, other than â€Å"neutral and detached magistrate† is invalid in violation of the Fourth and Fourteenth Amendments. A person’s home cannot be searched without their consent or without a search warrant.

Descartes ; Hume’s Theory on Knowledge

Knowledge is the things that one has taken into itself and made the decision to believe that it is true. This leads to the question, what makes certain obtained pieces of knowledge true? Descartes would doubt everything until he came to an absolute and undeniable truth. If he had any reason to doubt something, it could not be true knowledge. Descartes then discovered one thing that he could not doubt and that is â€Å"I think, therefore I am. † He says that if he can think, then he knows that he exists. I agree and disagree with Rene Descartes theory of how we have knowledge.Just because you have doubt about something does not necessarily mean there is no knowledge of it. What one may doubt, another person may have knowledge of. So is that person’s knowledge false? I say no. There are many situations like that. One may doubt the existence of God, but I do not doubt it. Since we all have our own beliefs, it does not mean one is wrong. So I do not agree with him saying th ere is no knowledge of things that he has the slightest doubt about. I do agree with his famous line â€Å"I think, therefore I am. † If one has the brain activity to think, then yes they do exist and that is certain.Since I am thinking, then I do have knowledge that I certainly exist. On the other hand, if one is in a coma then I still do believe that they exist. If you are living, breathing and your heart is beating then you without doubt exist even though you are not really thinking. One in a coma does have the ability to think once out of the coma so therefore they still exist. Hume was an empiricist and he believed that all knowledge comes through experience. If you want to know anything about what the world is like, you have to go out and explore; you cannot simply sit, think really hard and hope to come up with knowledge.He believed, along with the fact that knowledge is learned through experience, that a person's experiences are nothing more than the subjects of his o r her own perception. The knowledge of anything comes from the way it is observed through the five senses. Hume began to differentiate between feelings and thoughts. Feelings are only impressions made upon the body, and thoughts arrive from impressions; meaning you cannot have feelings on things you have not experienced. I do agree that one can gain knowledge through experiences, but also through being taught what we learn in school.In order for us to be taught things in school one had to experience the scientific study, math equation or whatever the material consisted of. People did not just come up with these facts on his/her own. They spent a lot of time researching and experiencing them to gain knowledge about whatever they learned. We do gain knowledge from things we experience on our own as well. The saying â€Å"People learn from their mistakes† is the perfect example. A child touches a hot stove and burns their hand, in doing so; they learn not to touch it because the y will remember what happened. In this case, they do learn from an experience.
